Northampton County judge sentences illegal alien in 'heinous rape case'

EASTON, Pa. | Punishment has finally been meted out for the man accused of raping a woman along the tow path in Bethlehem.

Northampton County Judge Paula Roscioli on Friday formally sentenced Justo E. Garcia to 10 to 20 years in state prison in connection with the May 2011 attack near the Minsi Trail Bridge. As part of a negotiated plea, the now 42-year-old agreed to plead guilty to a single count of rape, and the prosecution agreed to withdraw the remaining charges.

Garcia pleaded guilty last summer, but the judge was legally prohibited from sentencing him until a sexually violent predator assessment could be completed. In September, he tried a last-minute maneuver to withdraw his guilty plea, arguing it was invalid because of a faulty preliminary hearing. Garcia even went so far as to accuse his defense attorney of cooperating with the district attorney’s office.

The judge dismissed his arguments outright but agreed to delay sentencing until Garcia could be assessed by his own expert for the sexually violent predator assessment.

On Friday, the judge deemed Garcia a sexually violent predator, subjecting him to a lifetime of sex offender counseling. He was already subjected to a lifetime registration as a sex offender under Megan’s Law given the guilty plea to rape.

Before formally handing down the sentence, Roscioli called Garcia’s crime “vile and perhaps the most heinous rape case this court has ever seen.” Were it not for DNA evidence, he might have gotten away with it, she said.

Not only did the victim endure a vicious attack, but she endured the fear of knowing that her attacker could still be out there, the judge said. The law only allows the sentence that’s been applied, but Garcia’s conduct “dictates that you should be removed from society for the rest of your life,” Roscioli said.

When asked if he wished to address the court, Garcia said he plans on appealing his case and proceeded to air a list of grievances against his attorney and the court. He told the judge that he’s taken responsibility for everything in his life that he’s ever done, while reiterating that he wanted to plead no contest to rape.

In a no contest plea, a defendant doesn't admit guilt but acknowledges prosecutors had enough evidence to convict. It is treated the same as a guilty plea for the purposes of sentencing. The judge said previously she would not allow such a plea in this case.

Garcia told the court that other than his list of complaints about the case he felt bad about what happened to the victim.

Outside the courtroom, Chief Deputy District Attorney Tatum Wilson took issue with Garcia’s comments to the court, calling them offensive and far short of an apology to the victim.

“He is a monster,” Wilson said. “He’s what every woman is taught to fear.”

Garcia attacked the 19-year-old victim from behind, raped her along a jogging path and proceeded to complain at sentencing about how unfair the process has been against him, Wilson said. Garcia has proven how dangerous he is, she said, adding that she will personally oppose any parole request.

“He deserves to serve every second of his sentence,” Wilson said.

At the time of the attack, the victim told police she was jogging and had just passed under the Minsi Trail Bridge, when a man grabbed her from behind. She reported looking down to see her attacker holding what appeared to be a serrated knife, according to court records. Garcia dragged her toward the river through waist-high brush and sexually assaulted her.

The victim told authorities she stayed on the ground for some time in case her attacker was still nearby before immediately reporting the attack. Investigators used what the prosecution deemed overwhelming DNA evidence to link Garcia to the attack. They made the connection while he was serving state prison time in New Mexico.

In New Mexico, Garcia pleaded no contest to drug possession, aggravated battery, aggravated assault and resisting arrest during an incident in which he shot a woman in the shoulder, according to Wilson. Authorities in New Mexico were preparing to parole Garcia, when he was charged in the Northampton County case.

Illegal Alien Charged With Brutal Child Rape In Alabama

A man has been arrested in Marshall County on several sexual abuse charges related to an incident going back five years, authorities say.

According to jail records, Mateo Reynoso, 22, was booked Monday on charges of first degree rape, first degree sodomy and sexual abuse of a child under the age of 12.

He is being held in the Marshall County Jail on $25,000 bond.

Albertville police say the charges stem from an incident that reportedly happened back in 2016.

Roy Cooper has allowed localities to do just that. And, upon taking office, current Wake County Sheriff Gerald M. Baker ended his department’s participation in the 287(g) program which allowed deputies to investigate an inmate’s immigration status and report them to ICE.

Sheriff Baker has refused to honor ICE holds, even for those charged with crimes against children. So, if Ramirez-Roblero can make bail, he will simply be released back onto the streets of Raleigh, NC.

Will Biden Block Another Deportation Of This Illegal Alien Convicted Child Killer?

ST. PAUL, MN - In November 2019, U.S. Immigration and Customs Enforcement (ICE) received a tip that Olga Marina Franco Del Cid, 35, was back in Minnesota, after having been deported in 2016, following her release from prison. She was taken into custody later that same month.

On June 11, 2020, U.S. District Court Judge Susan Nelson sentenced Del Cid to 24 months in federal prison, after she pleaded guilty to illegal re-entry after removal and using a false Social Security number.

She should be deported again, following her release.

However, that is now in question, following the Biden administration's new orders on deportations.

So, why was she deported the first time?

In February 2008, Olga Marina Franco Del Cid (a.k.a. Alianiss Nunez Morales) went sailing past a stop sign on County Road 24 in Cottonwood, Minnesota, and right into a school bus carrying 28 Lakeview School students. The bus flipped over on its side, injuring several children and killing four others (Emilee Olson, 9; Hunter Javens, 9; Jesse Javens, 13; and Reed Stevens, 12).

In addition to the children who were killed, four others were hospitalized at Avera McKennan Hospital and University Health Center in Sioux Falls, South Dakota. Another child was transported to the Mayo Clinic.

Del Cid who originally gave police her alias, told investigators that she was on her way to work when she caused the fatal wreck. Despite her illegal status, she was employed by Norcraft Cabinetry in nearby Eagan.

Apparently, the illegal alien was not even licensed to drive in her own country of Guatemala. Lt. Mark Peterson of the Minnesota State Patrol told reporters:

“She doesn’t have a drivers’ license anywhere that we’re aware of.”

Of course, that was not the Guatemalan's first brush with the law. In 2006 she pleaded guilty in a Chippewa County court to driving without a license.

In August 2008, a Kandiyohi County jury convicted Del Cid on four counts of criminal vehicular homicide and 17 counts of criminal vehicular operation, giving a false name to police, failing to stop at the entrance to a thruway and driving without a valid license. She was subsequently sentenced to 12 and a half years in prison.

A Guatemalan woman who spent eight years in prison for causing a fatal school bus crash in southwestern Minnesota and was later deported has been sentenced to another two years in prison for coming back into the United States.

Olga Marina Franco del Cid of Inver Grove Heights was sentenced Thursday in U.S. District Court in St. Paul after pleading guilty to illegal re-entry after removal from the country and using a false Social Security number.

Once the two years have been served, Franco del Cid will again be deported, according to U.S. Immigration and Customs Enforcement (ICE).

In 2008, Franco del Cid ran a stop sign and crashed a van into a school bus in Cottonwood, killing four children under age 13. The crash further fueled the national immigration debate. She was convicted of four counts of criminal vehicular homicide and 17 counts of criminal vehicular operation, giving a false name to police, failing to stop at the entrance to a thruway and driving without a valid license.

Responders at the scene found Franco del Cid behind the steering wheel, her right foot wedged under a crumpled dashboard near the accelerator. Her attorneys argued that her boyfriend was the one driving and fled because he didn’t want to be deported to Mexico. They argued that he was thrown out of the van on impact, and Franco del Cid was thrown into the driver’s seat.

Franco del Cid was deported in 2016 after her release from prison. ICE took her into custody in November after receiving a tip that she had returned to Minnesota.
