I welcome all libertarians and lovers of freedom and our first amendment rights to the resistance. Those of you who think looting is a capital offense or that the right to assemble is subject to the whims of the government are welcome to move to Russia or China.

But it does make you wonder about every other criminal conviction based solely on a police report, doesn't it.
Well, it's worse than you realize.

In general, police reports aren't admissible evidence because they're hearsay. However, there are hearsay exceptions. One of the most common is "admission against interest."

What this means is that people who talk to police thinking that consistently telling the same story from immediately following the incident will help them show they are telling the truth are only accomplishing the opposite.

They don't realize those statements won't be evidence UNLESS the statement harms them. The very rules of evidence creates a legal regime that talking to police can only harm a criminal defendant.
